The Mountain Men Ltd Terms and Conditions:
How these terms and conditions apply to our contract:
We consider these terms and conditions (the “Terms”) and our prices to set out the entire agreement between you and us for the supply of our services to you. Only these terms shall apply to our contract with you.
Please check that the details in these terms and conditions and your booking request are complete and accurate before you commit yourself to the contract. If you think that there is a mistake, please make sure that you ask us to confirm any changes in writing, as we can only accept responsibility for statements and representations made in writing by our authorised employees and agents.
Please ensure that you read and understand these Terms before you submit your booking request. You may only request a booking if you agree to these Terms. By submitting a booking request, you are deemed to have accepted these terms. This does not affect your statutory rights as a consumer.
The Mountain Men sells all-inclusive overnight camping trips and instructional courses via our website, www.mountainmen.scot (the “Website”) and by direct contact. Any person wishing to make a booking via any of these methods (referred to as “you/your”) acknowledges that such booking is made subject to these Terms. We reserve the right to change these Terms at any time. Any such changes will take effect immediately when posted on the website or otherwise brought to your attention.
It is your responsibility to read the Terms each time you submit a booking request and any such request shall signify that you have accepted to be bound by the latest set of Terms. A copy of the latest set of Terms is available on the Website and upon request. In addition to these Terms, there may be specific rules and regulations that apply to individual sites. Please contact The Mountain Men in advance of your arrival if you require further details of any site-specific rules and regulations.
Making a Booking:
You can book online via our website, www.mountainmen.scot . Please check your confirmation as The Mountain Men cannot be held responsible for errors in information provided at the time of booking.
When making a booking you agree that you are at least eighteen years or over, you have the authority of all persons in your party to book on their behalf, you accept these Terms & Conditions and you agree to be responsible for any loss or damage caused by any member of your party accompanying you.
For groups, the name, email address and contact number of the lead booking in the party needs to be provided at the time of booking. Failure to provide this may lead to the booking being cancelled.
Unfortunately, we cannot accommodate infants at this time. Children must be able to occupy their own seat on the minibus, aided by booster seat if required. If travelling with children please advise The Mountain Men of seating requirements, i.e. booster seats.
We cannot accommodate pets on our trips at this time unless your party completes the full booking
All our trips are overnight, accommodation will be in shared tents, family tents and individual tents are available on prior request. In the case of The BackPacker Experience we will use lightweight back packing tents, either an individual tent (for 1 person) or a 3 person tent (which will be shared between 2).
All sites are to be used for recreational camping only.
Prices:
The prices advertised are accurate at the time of booking. We reserve the right to increase or decrease our charge rate but the price you receive at time of booking will be your set rate regardless. Customers are advised to check the website for the most up to date information including our latest promotions, deals and discounts. Although prices may vary from time-to-time, the price payable is the price confirmed at the time of booking. The prices are based on a per person per trip rate unless otherwise stated.
Prices include VAT at the current prevailing rate.
Group and family bookings can be accepted, a group/family discount may be applied, please enquire at time of booking.
Discounts may be applied to bookings of four or more.
Promotions, deals or discounted offers are provided at the discretion of The Mountain Men Ltd. All offers are subject to availability, cannot be used in conjunction with any other offer or discount and may be withdrawn at any time.
Retrospective refunds are not permitted against any offer or promotion advertised after such time a booking is made.
The Mountain Men are happy to accommodate up to 8 visitors per trip, larger groups may be accommodated with sufficient notice, to a maximum of 12.
Payment:
Some of our Experiences allow you to pay a deposit at time of booking. In all instances full payment must be received 21 days prior to trip. In the event full payment is not received in time we will issue a friendly prompt to remind you, if 7 days prior to the event you have failed to pay the balance or contact us to discuss further terms you will leave us no option but to enforce our cancellation policy. Promotional Experiences may have different payment terms, please check at time of booking.
We accept payment by pay-pal, most major credit and debit cards via online payment and bank transfer. Unfortunately, we cannot accept payment by cheque in advance or on the day. Our online payments are processed by third parties and as such we do not receive your card details nor are they retained by us.
Cancellation Policy:
Scottish Experience:
Cancellations up to 21 days prior to event will receive 100% refund, between 21 and 7 days prior to the event a 70% refund, cancellations with 7 days or less will receive no refund. In the event we resell the place at any time a full refund will be made.
Courses:
Cancellations on any of our courses up to 7 days prior to course start will receive a full refund. Cancellations after this time will receive no refund. (In the event we resell the place at any time a full refund will be made.)
Cancellations can be made by contacting The Mountain Men direct using our contact email on our website. Please ensure you receive written confirmation back.
In the event the cancellation is of our fault we will offer you an alternative date, a credit note or a full refund (including charges).
All refunds are less charges if applicable. (pay-pal and card transfers incur charges)
Voucher Use and Cancellation Policy:
Vouchers have no monetary value and cannot be exchanged for cash
Vouchers may be used as described in voucher description, there is no expiry date on our vouchers unless it is specified on the voucher itself.
Any experience or course paid for or part paid for by voucher may be cancelled up to 7 days prior to event taking place, in this event the voucher will remain active and may be used at a later date. Cancellations less than 7 days prior to event will render the voucher as void unless in the event we can resell the place, in which case we will reactivate the voucher. If the voucher is used in part payment for an event the monetary payment will be subject to our standard terms and conditions.
Pick Up and Drop Off: (Not applicable to Courses)
It is important that you arrive at your designated pick up location on time. Your departure time and location will be included in your booking information. In the event of a no show we will attempt to contact the lead person to ascertain the reason for delay and where possible will wait or if possible meet you.
In the event of a no show and no contact established our driver will wait 15 minutes from departure time and then leave. At this point we will treat your booking as a cancellation with no monies returned.
Drop off will be as close to your home as we can make it.
In the event an individual or group arrives for departure and our driver cannot determine that the individual or at least one member of the group is aged 18 years or older the individual or entire group will be refused travel. No monies will be refunded.
Management and Behaviour on-site:
Our Site Manager and their teams are fully empowered in all aspects of site operation and management. The Mountain Men fully supports its Site Managers and teams in dealing with matters of policy at their sole discretion when the need arises. In placing a Booking Request, you agree that you and your party will comply with the requests of the Site Managers and their teams, in such that these requests are deemed reasonable.
As the person booking the tour, you are responsible for the behaviour of all members of your party at all times.
To protect our countryside, the burning of wood is strictly confined to the onsite fire-pit and only wood supplied by The Mountain Men may be used. The Mountain Men will supply smokeless wood logs for this purpose.
Our vehicles are governed by Scottish Law and as such no alcohol may be consumed in our minibus, also smoking or the use of electronic cigarettes/vapes is prohibited.
Wilful Damage:
Our customers come on these trips to enjoy the majesty and serenity that is Scotland, you are reminded that others may be in your group and asked to respect them and yourself. If anyone does not respect this we reserve the right to remove you from the group and return you to Glasgow forthwith, no monies will be refunded.
To respect the enjoyment of others, we ask that noise levels are kept to a minimum after 10:30pm.
Complaints:
We want you to have an enjoyable trip. Should you have cause for complaint, please contact our Site Manager immediately who will try to resolve your complaint and advise you of our complaints procedure.
We ask you to note that if you do not give us the opportunity to resolve the problem by reporting it on-site, we may not be able to deal with any complaint on your return and your rights to claim may have been reduced or forfeited.
If, at the end of your stay with us you feel we have not dealt with your complaint satisfactorily we ask that the main booker submits a written complaint within 28 days of your return to: The Mountain Men, 2nd Floor, Clyde Offices, 48 West George Street, Glasgow, G2 1BP or through our website using our contact form.
Data protection:
The Mountain Men retain your details for your trip, periodically we will delete retained data. Full details of our privacy policy below.
Liability:
Please read this section as it is important that you understand what you are agreeing to.
Nothing in this section limits or attempts to limit our liability for:

Death or personal injury caused by our negligence; or

Fraud or fraudulent misrepresentation; or

Any breach of the obligations implied by Section 2 of the Supply of Goods and Services Act 1982; or

Losses for which it is prohibited in Section 7 of the Consumer Protection Act 1987 to limit liability; or
-
Any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.
Subject to the matters detailed above, if we fail to comply with these Terms, we shall not be responsible for any losses that you suffer as a result, except for those losses which we could reasonably foresee would result from our failure to comply with these Terms.
In addition to the above, we shall not be responsible for any:

Our maximum liability shall be no more than to refund the amount paid by you for the trip.
As our Sites are located in an outdoor environment, we do not accept responsibility for any damage, injury or inconvenience caused by plants or wildlife.
The Mountain Men do not accept responsibility for anything that adversely affects your trip that is outside of our control. These circumstances are known as ‘Force Majeure’ events and are circumstances that The Mountain Men could not, even with due care, have foreseen or avoided. Such circumstances include (but are not limited to) war, civil unrest, industrial action, terrorist activity, natural disaster, fire, adverse weather conditions, foot and mouth disease and all other similar events outside of our control.
The Mountain Men will endeavour to manage any problems caused as a result of a Force Majeure event but shall be under no obligation to do so and shall not be liable to you for any losses caused by a Force Majeure event.
Reference to any products, services or other information belonging to third parties does not imply or constitute an endorsement, sponsorship or recommendation by The Mountain Men.
Links to other services not operated by The Mountain Men are provided solely for your convenience. The Mountain Men accepts no liability for any products services or other information provided by third parties.
Other Important Information:
Any photographs, descriptions or advertising we issue, and any descriptions or illustrations contained in our catalogue, or brochures or on our Website, are issued or published solely to provide you with an approximate idea of our Sites and services. They do not form part of the contract between you and us.
If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the Term will, to that extent only, be severed from the remaining Terms, which will continue to be valid to the fullest extent permitted by law.
If we fail at any time while these Terms are in force, to insist that you perform any of your obligations under these Terms, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations.
Any waiver of a default by us does not mean that we will automatically waive any subsequent waive by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably.
We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.
These Terms and any non-contractual obligations relating to these Terms shall be governed by and interpreted in accordance with Scottish law. You and we both agree to the exclusive jurisdiction of the Scottish courts.
This contract shall be concluded in the English language.

Privacy Policy:
We collect and store your personal information solely for use in conducting our daily business, your info is securely stored on our 3rd party server. All our photographs and films are rights reserved and with kind permission of the individuals for use on our site. In addition, we use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.
Any contact information you send us via our email system is stored securely on our email server and is not used for any other purpose than Mountain Men business.
